Plaint Drafting Under Order VII CPC: Structure and Checklist
The plaint under Order VII CPC is the foundation of a civil suit. It must disclose a complete cause of action and meet all mandatory particulars or risk rejection under Order VII Rule 11.
Mandatory particulars (Rule 1)
- Name of the court; names, descriptions, and addresses of parties
- Facts constituting the cause of action and when it arose
- Facts showing that the court has jurisdiction
- Relief claimed; value of subject matter for jurisdiction and court fees
Order VII Rule 11 rejection grounds
- Does not disclose a cause of action
- Relief undervalued and not corrected in time
- Insufficiently stamped
- Suit appears barred by law (incl. limitation)
